For the delivery of products and the provision of services

1. general, scope of application

These General Terms and Conditions (GTC) apply to all our business relationships, in particular to the ordering or delivery of products and the provision of services. Viocap AG does not recognize any deviating general terms and conditions unless Viocap AG has expressly agreed to them in writing.

2. conclusion of contract (online store)

The product range offered in the online store is a non-binding presentation. It does not constitute an offer to conclude a purchase contract with Viocap AG. If a customer places an order online, this constitutes an offer to conclude a purchase contract with Viocap AG; the same applies to orders placed by telephone or in writing.

The purchase contract between the customer and Viocap AG is only concluded when Viocap AG accepts the customer's order by sending the ordered goods to the customer or by issuing an invoice or by an express declaration of acceptance.

3. terms of payment, prices

The prices of our offers are shown in Swiss francs (CHF) and include the statutory value added tax in Switzerland. Shipping costs are not included in the prices quoted. Additional customs duties, taxes and fees may apply for deliveries abroad. Errors and price changes excepted.

It is possible to pay in cash, via Paypal or by debit or credit card. As a rule, payment must be made in advance, especially for new and private customers. Dermatologists and cosmetic institutes receive the ordered goods on account with a 30-day payment period.

After expiry of the payment deadline, the customer is in default without further reminder. In this case, Viocap AG is entitled to charge default interest at the usual bank rate in addition to reminder fees.

4. reservation of title

The goods remain the property of Viocap AG until payment has been made in full.

5 Delivery, shipment, transfer of risk

Ordered products are dispatched by post or courier service. Delivery times are approximate and therefore non-binding. The products must be checked for correctness, completeness and intactness immediately upon arrival. The risk of accidental loss and accidental deterioration of the goods sold shall pass to the customer upon handover to a suitable transport person or to the customer himself or to a person designated by the customer.

6 Warranty for material defects

Incorrect deliveries or defective deliveries must be reported to Viocap AG in writing immediately, but at the latest within five days of receipt of the goods, and returned within 14 days.

Obvious defects must be reported to Viocap AG immediately, but at the latest within five days of receipt of the goods. Viocap AG must be notified of hidden defects that only become apparent at a later date immediately, but at the latest within five days of their discovery and in any case before the expiry of the declared expiry date of the goods. Warranty claims due to defects in the goods expire two years after delivery of the goods to the buyer.

Viocap AG reserves the right, at its own discretion, to either repair defects covered by the warranty free of charge or to supply an equivalent replacement. Viocap AG is also entitled to withdraw from the purchase contract and refund the purchase price in the event of justified warranty claims. Alternatively, Viocap AG may decide to reduce the purchase price and refund only the reduced value of the goods.

7. no right of return

For reasons of hygiene, it is generally not possible to exchange or return our products (e.g. goods ordered by mistake or goods that are subsequently no longer required).

8 Liability for product deliveries

Viocap AG's liability is limited to gross negligence and willful misconduct. Viocap AG is in no way liable for damages that have not occurred to the delivery item itself; in particular, Viocap AG is not liable for indirect damages, loss of profit or other financial losses of the customer or third parties. Furthermore, any compensation for missing or delayed delivery is excluded.

9. duty of care

All products must be used in strict compliance with the instructions, precautions and guidelines applicable to them. Viocap AG accepts no liability in the event of incompatibility or lack of success.

10. data protection

All personal data will be treated confidentially and will only be passed on to other companies for order processing. Viocap AG is entitled to transmit personal data to third parties for the purpose of credit checks and creditworthiness monitoring.

11 Place of jurisdiction, applicable law

Swiss law is applicable. The ordinary courts at the registered office of Viocap AG shall have jurisdiction.
